Terms of Use

1.         INTRODUCTION

1.1       The game of Fanslide (“Fanslide”) is made available by Slide Gaming Ltd, a company registered in England with company number 12988251 whose registered address is 58a Burma Road, London, United Kingdom, N16 9BJ (“us”, “we” or “our”).

1.2       All individual Fanslide games (“Games”) are sponsored by Slide Gaming Ltd. They are not sponsored or endorsed by, or associated in any way with Apple Inc or Google, or any of the competitions, clubs or players whose names may feature within the Games.

1.3       Fanslide is a live game played alongside individual, real life football matches (each a “Fixture”).

1.4       Fanslide is a free to play game of skill. Fanslide is not a betting product.

1.5       From time to time we may offer free to enter prize competitions (“Prize Competitions”) based on individual Games or a selection of Games.

1.6       Fanslide is available via our mobile application (the “App“).

 

2.         FANSLIDE TERMS

2.1       The following terms and conditions (collectively, the “Fanslide Terms“) apply to your use of Fanslide and the App:

  • these terms of use (“Terms of Use”), which set out the basis on which you are allowed to access and play Fanslide;
  • the “Game Rules“, which are a separate set of rules that explain how the game of Fanslide works. All Games of Fanslide are operated and settled in accordance with the Game Rules;
  • the “Prize Competition Rules“, which apply to any Prize Competitions you may enter; and
  • any other applicable terms and conditions in force from time to time, for example in relation to promotions you enter or referral schemes you enrol in (you will be notified of any such additional terms before they apply to you).

 

3.         ACCEPTANCE OF TERMS

3.1       By installing or using the App, creating an Account or otherwise playing or accessing Games, you confirm your acceptance of the Fanslide Terms.

3.2       If you do not agree to the Fanslide Terms, you must immediately uninstall the App and discontinue its use.

3.3       By entering a free entry Prize Competition you confirm your acceptance of the Prize Competition Rules.

3.4       You agree that you will only use Fanslide for your personal entertainment and that you will not use Fanslide to conduct a commercial business.

3.5       By using the App you acknowledge that your information will be used in accordance with our Privacy Notice.

3.6       These Terms of Use incorporate the Google Play Store and Apple App Store terms and conditions and privacy policies (“Platform Terms”). If there is any conflict between the Fanslide Terms and the Platform Terms, then the Fanslide Terms will prevail.

 

4.         CHANGES AND AVAILABILITY

4.1       We may amend the Fanslide Terms from time to time. We may do this for example to reflect changes in law, or best practice, or because we’ve changed the functionality of Fanslide or the App.

4.2       We will ensure that any material changes to the Fanslide Terms will be notified to you before they come into effect by an appropriate method (for example via a prominent notice on the App or via email). The material changes will apply to the use of the App and the Games made available after we have given notice.

4.3       Any changes to the Fanslide Terms will not apply in relation to any Games or Prize Competitions that you have already entered.

4.4       We recommend that you check the Fanslide Terms on a regular basis to keep yourself informed of any changes.

4.5       If you continue to use this App, you are deemed to have accepted any changes we make to the Fanslide Terms. If you do not agree to such changes, you should not use the App.

4.6       We may update the App automatically to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the App for these reasons. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App or functionality may be impaired.

 

5.         THIRD PARTY AND PROPRIETARY DATA

5.1       We use a third party data provider, currently Stats Perform, via their Opta data feed (“Opta”). This third party provides live match data from the Fixtures featured in our Games.

5.2       This data and all other information displayed on the App is made available to you for your general information and entertainment, and are for non-commercial use only.

5.3       You acknowledge that the provision of such data (and therefore the making available of the App) is always subject to any arrangements, restrictions or prohibitions imposed by any sports body (including any league, association or authority), any team, official or other participant in any match or event, or of any rights holder, agency or other person involved in the control, management or exploitation of any rights to or in respect of any match or event. Any decision, order, act or omission made by such person is outside of our control and therefore, to the extent it affects our ability to make the whole or any part of the App, or any Games available to you for your use in accordance with the Fanslide Terms, you acknowledge that we shall not be liable to you for any such failure or delay.

 

6.         ELIGIBILITY

6.1       To use the App, create an Account and play Games of Fanslide you must be at least 13 years of age.

6.2       We reserve the right to ask you to provide satisfactory evidence to prove that you meet the eligibility criteria, at any time.

6.3       If we have reasonable grounds to suspect you do not meet the eligibility criteria we may, without limiting the options available to us, block your use of the App and/or close your Account.

 

7.         REGISTERING FOR AN ACCOUNT

7.1       To play Fanslide you must register for a Fanslide account (an “Account”).

7.2       To register for an Account you must provide personal information including (but not limited to) your full legal name, date of birth, postal address and email address.

7.3       We may require further information from you to enable us to verify your identity, name, age and address in order to meet anti-money laundering and/or prevention of terrorism legislation and regulations. This may include but is not limited to copies (including certified copies) of your passport/valid photo ID and satisfactory proof of address, including but not limited to recent utility bills (within the last 3 months) and/or bank statements (and the requirement for such can be made by Us at any time).

7.4       Before completing your Account registration we may verify the personal information you provide. We may use third-party age and identification verification agencies to assist us in verifying the information you provide during registration.

7.5       If we are unable to verify your information, we may use third-party age and identification verification agencies to perform additional checks. We may ask you to upload, or take a photograph of, an identity document, such as your driving licence or passport, and/or take a photograph of yourself in order to confirm you are the same person shown in the document.

7.6       You may only have one registered Account at any one time.

7.7       You will not be able to register a new Account with personal information which is also being used on an existing registered Account.

7.8       We may contact you at any time and require you to satisfy us that you are not in breach of these Terms of Use by operating multiple Accounts at the same time.

7.9       When creating an Account you must choose a username and have the option of adding a profile picture. Usernames and profile pictures are visible to other users and must not: (i) be obscene or offensive, (ii) infringe any third party rights, or (iii) otherwise (in our absolute discretion) be considered inappropriate.

7.10    We may remove your profile picture or ask you to choose a different username at any time and without giving a reason.

7.11    You can ask us to delete your Account at any time by emailing [email protected] or using the ‘Delete Account’ function in the App. We will delete your Account within 30 days of receiving your request. Once we have deleted your Account it cannot be recovered.

7.12    Upon deleting your Account we will retain all data relating to your Account, game history, transaction history and all other records of your interactions with the App for a period of seven years, in line with our Privacy Notice.

 

8.         USE OF THE APP

8.1       In return for you agreeing to comply with the Fanslide Terms, you may download, view, use the App and play Games for your personal, non-commercial use only.

8.2       You may download the App onto as many of your compatible devices (“Devices”) as you wish to, but you may only have one Account and each Device may only be used to access one Account.

8.3       As set out in the Game Rules, you may only use one device to participate in any one Game.

8.4       Fanslide hereby grants you a non-exclusive, non-transferable, revocable licence to use the App on your Devices, subject to the Fanslide Terms.

8.5       You are responsible for ensuring that no one else uses the App on your Devices, either to access your Account or use the App using a different Account.

8.6       You acknowledge that your agreement with your mobile network provider will apply to your use of the App.

8.7       You acknowledge that you may be charged by your mobile provider for data services while using certain features of the App or any such third party charges as may arise and you accept responsibility for such charges.

8.8       If you are not the bill payer for the Device being used to access the App, you must obtain, and will be assumed to have received, permission from the bill payer for using the App.

8.9       You are responsible for any use of the App with your Account details (including unauthorised use), and for protecting your Account details from unauthorised use.

8.10    You are responsible for the security of any device from which you sign in to your Account.

 

9.         WITHDRAWING FUNDS

9.1       In the event that you win prize money in a Prize Competition, this money will be credited to your Account and you may then withdraw it.

9.2       Our payment processor is PayPal. You must have a PayPal account, in your own name, in order to withdraw a balance from your Fanslide Account.

9.3       We do not offer any alternative means of withdrawing funds. If you do not have a PayPal account, or if PayPal do not operate in your country or allow citizens of your country to receive funds via PayPal then you will not be able to withdraw any winnings from Prize Competitions.

9.4       You may only withdraw your full Account balance in any one transaction.

9.5       You are responsible for any taxation which may apply to your activity on our Service.

9.6       Should sums be paid to your Account in error, it is your responsibility to notify us of the error without delay. Any sums credited to your Account due to an error will be deemed invalid and in the event there are sufficient sums in your Account, such sums will be immediately reversed by us from your Account. In the event that there are insufficient sums in your Account, you shall immediately return to us the funds representing the erroneously credited funds. Amounts credited to your Account in error are not available for you to withdraw and we reserve the right to void any transaction involving such sums paid in error to you. You agree to return to us any amounts representing erroneously credited sums that you have withdrawn from your Account.

 

10.     VOID GAMES AND PRIZE COMPETITIONS

10.1    We may declare a Game void in the following circumstances:

  • in the event that a scheduled Fixture is postponed and does not kick off before 23:59 local time on the day it was originally scheduled;
  • in the event that a Fixture kicks off, but less than 60 minutes are played (excluding any stoppage time added at the end of the first period of the match – i.e. the game clock does not reach 60:00 in the second period), for whatever reason (for example the Fixture is abandoned); or
  • in the event that we have to abandon a Game of Fanslide as a result of technical issues beyond our reasonable control, where less than 60 minutes are played (excluding any stoppage time added at the end of the first period of the match – i.e. the game clock does not reach 60:00 in the second period). In providing Games we rely upon a number of third parties, including Opta, our data provider and Amazon Web Services (“AWS”) who provide the cloud based systems that our Games operate on. Consequently, the provision of our Games is subject to factors and circumstances outside of our control and there may be times when we are unable to provide the Games as advertised, or be forced to abandon Games that have already begun. For example, we may have to abandon a Game:
    1. in the event of a significant service interruption affecting either the incoming live data feed from Opta or AWS cloud services;
    2. if we reasonably believe the integrity or accuracy of the live Opta data has been compromised, or if we suspect a security breach or attempted security breach may impact or may have impacted, the integrity and fairness of the Game; and/or
    3. in the event of any other failure or significant issue in relation to a third party that is necessary for the provision of the Game.
  • Please note that any Game that is abandoned, for any reason, in which the game clock has reached 60:00 in the second period of the match, will not be declared void, save for the case outlined in 10.1.5.
  • In the event that a technical disruption under 1.3 forces us to abandon a Game and the technical issues are to such an extent that we are unable to fairly settle the Game, then the Game will be declared void regardless of how much time has elapsed.

10.2    In the event that a Game of Fanslide is declared void:

  • no Points or achievements from the Game (for example, Highest Score, Games Played or PFGs Scored) will be recorded on your Account;
  • all Prize Competitions operating on the void Game will be declared void; and
  • no Points or achievements from the Game (for example, Highest Score, Games Played or PFGs Scored) will count towards any Prize Competitions.

10.3    We shall have no liability to you, and no compensation shall be made to you in respect of any void Games.

10.4    We shall have no liability to you if a Fixture is abandoned or cancelled for any reason.

 

11.     USER GENERATED CONTENT AND CHAT

11.1    We offer you the opportunity to upload, post and otherwise transmit certain content via the App, including to make contact with other users of the App via the ‘Chat’ functionality during Games, creating names for your groups and/or uploading icons and images to your groups (“Content”).

11.2    You warrant that your Content will not contravene the Prohibited Uses section below, and you acknowledge and agree that, if your Content does contravene the Prohibited Uses section, you will be liable to us for any loss or damage we suffer as a result.

11.3    We have the right to remove any Content from the App if, in our opinion, such Content does not comply with these Terms of Use or removal is otherwise desirable for business or operational reasons.

11.4    We also reserve the right, acting reasonably, to disclose your identity to any third party who is claiming that your Content infringes their intellectual property rights or their right to privacy.

11.5    We reserve the right to monitor and review Content, but do not have the obligation to do so. You acknowledge that, unless expressly stated otherwise, Content has not been verified or approved by us.

11.6    Views expressed by other users on the App do not represent our views or values. We will not be responsible, or liable to any third party, for the content or accuracy of any Content posted by you or any other user of the App.

11.7    Any Content you upload to the App will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your Content, but you grant us a worldwide, non-exclusive, transferable, royalty-free licence (with the right to sub-licence) to use, store, copy, adapt, make available to the public, translate, distribute and otherwise exploit such Content (in whole or in part) for the purpose of operating, improving and promoting the App.

11.8    The chat function in Fanslide is not monitored by us but relies upon self-regulation by all users via the chat reporting function.

11.9    In the unfortunate event that you see an offensive chat message in Fanslide, please take the time to report it. You can report a message by pressing and holding or double tapping on the message in question and choosing the “Report Message” option.

11.10 Any message reported by three or more users will be removed (however any user deemed to have abused the reporting function to frivolously report messages that do not breach these Terms of Use may have the ability to report messages removed).

11.11 We reserve the right to close the Account of any user who posts comments deemed discriminatory, offensive or inappropriate.

11.12 We reserve the right to withdraw the chat function altogether, or remove your individual ability to post chat messages without giving a reason.

 

12.     ACCOUNT CLOSURE, ACCOUNT SUSPENSION AND DORMANT ACCOUNTS

12.1    Account closure by you

  • You are entitled to close your Account and terminate the legal agreement between you and us under the Fanslide Terms. You can contact us at any time:
    1. confirming your wish to close your Account; and
    2. (if you wish) stating the reasons for Account closure.
  • We will endeavour to respond to your notification within a reasonable timeframe confirming the date upon which your Account closure will take effect, provided that you continue to assume responsibility for all activity on your Account until such time as closure takes effect, at which point the agreement under the Fanslide Terms shall terminate.
  • These Terms of Use give us the right to terminate/close your Account in certain circumstances (see, for example, clauses, 5 and 17.1).
  • Any balance in your Account at the time of any closure (by you or us) will not be paid back to you.
  •  

12.4    Suspension by us

  • We retain the right, at our sole discretion, to suspend your Account pursuant to the provisions set out in these Terms of Use. Following Account suspension you will be prohibited from using our Services, including making withdrawals, until the date upon which your Account is re-activated by us.
  • We shall as soon reasonably practicable address all matters that have given rise to Account suspension in order to resolve any issues so that your Account may, in our absolute discretion, be re-activated or terminated by us.
  • If we have reasonable grounds to suspect that you have engaged in any Prohibited Use, we may suspend your Account without notification, and your Account will remain suspended while the matter is investigated. You agree to cooperate fully with any such investigation. Your funds cannot be accessed or withdrawn during periods of suspension, and any balance will remain in the Account.
  • If our investigation results in our decision (acting reasonably) that the issue has been resolved to our satisfaction, we may lift the Account suspension. If our investigation results in our decision (acting reasonably) that you have engaged in any Prohibited Use, we may restrict or permanently close your Account. In these circumstances, your details may be passed on to any applicable regulatory authority or any other relevant external third parties.
  • We may also from time to time be required by a competent authority to restrict, suspend or close Accounts for legal or regulatory reasons. Such restrictions, if applicable, may affect your use of your Account.

12.5    Dormant Accounts

  • We will deem an Account to be “dormant” after a period of 12 (twelve) months in which you do not play at least one Game of Fanslide.
  • You may reactivate a dormant account at any time by logging into that Account and playing a Game of Fanslide.
  • Should your Account become dormant, we will continue to contact you (where you have “opted-in”) with promotional messages until such time as you instruct us to stop. However, we will also contact all Account holders periodically to advise of any Account balance.
  • Please note, your Account will be deleted following the time period of 7 (seven) years of consecutive inactivity. Upon deletion of your Account, we will no longer retain your personal details and as such we are unable to continue to offer an Account balance refund.

 

13.     INTELLECTUAL PROPERTY

13.1    You acknowledge and agree that all rights of whatever nature in and to the App are owned by and expressly reserved to the Company or its licensors.

13.2    Other than the right to use the App in accordance with the Fanslide Terms, you have no intellectual property rights in, or to, the App or any related intellectual property rights (such as rights in the Fanslide name and logos, in the trade marks of the Company, in the Games graphics or format, or in any third party data).

13.3    You agree:

  • not to copy the App except where such copying is incidental to normal use of the App, or where it is necessary for the purpose of back-up or operational security;
  • not to sub-licence or otherwise make available the App in whole or in part (including object and source code), in any form to any person without prior written consent from us;
  • not to make alterations to, or modifications, adaptations or translations of, the whole or any part of the App, or permit the App or any part of it to be combined with, or become incorporated in, any other programs;
  • not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the App or attempt to do any such thing; and
  • to comply with all technology control or export laws and regulations that apply to the technology used or supported by the App.

13.4    The App and all other content featured in the App (including the game mechanics) are protected by copyright, trade mark, patent and/or other intellectual property and proprietary rights which are reserved to the Company and/or its licensors.

 

14.     PROHIBITED USES

14.1    You agree:

  • not to open more than one Account;
  • that you will not engage in criminal activities including but not limited to money laundering;
  • that you will not engage in fraudulent activity including but not limited to: (i) the collusion by you with others to gain an unfair advantage (including through bonus schemes or similar promotions offered by us); and (ii) any attempt to register false or misleading account information;
  • not to mask an IP address or use a virtual private network to access Fanslide;
  • not to use the App in any way, or for any purpose, that:
    1. is unlawful, illegal or unauthorised;
    2. would reasonably be considered cheating;
    3. encourages or facilitates others to cheat in any Game;
    4. infringes any copyright, database right or trade mark of any other person;
    5. is likely to disrupt our service in any way including, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the App, or any operating system;
    6. advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement, computer misuse, or collecting or harvesting any information or data from our systems or servers;
    7. is defamatory of any other person;
    8. is obscene or offensive;
    9. promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
    10. involves using automated devices, scripts, bots, spiders, crawlers or scrapers (except for standard search engine technologies); or
    11. is likely to harass, upset, embarrass, alarm or annoy any other person,

(each activity under clauses 14.1.1 to 14.1.5 inclusive being a “Prohibited Use“).

14.2    Any Prohibited Use by you will constitute a material breach of these Terms of Use.

14.3    We will not be liable for any loss or damage which you may incur as a result of any Prohibited Uses on your part.

14.4    You agree to compensate us for any costs, charges or losses sustained or incurred by us arising from any Prohibited Uses on your part.

14.5    Where we determine that a Prohibited Use has been committed by you then we reserve the right to refuse a transaction, suspend or terminate your Account with immediate effect, and to withhold the whole or part of the balance and/or recover from the account the amount of any deposits, pay-outs, bonuses or winnings which have been affected by or are in any way attributable to any Prohibited Use. Our rights set out in this paragraph do not affect any other rights (including any common law rights) we may have against you, under the Terms of Use or otherwise.

14.6    In exercising any of our rights in respect of Prohibited Uses, we shall use all reasonable endeavours to ensure that, while complying with our regulatory and other legal obligations, we exercise such rights in a manner which is fair to you and to our customers.

 

15.     NO PROMISES

15.1    We provide the App on an ‘as is’ and ‘as available’ basis, without any promises or representations, express or implied. In particular, neither we nor any third party data provider make any representation regarding the validity, accuracy, reliability, suitability or availability of the App, including any data provided on the App. You hereby acknowledge that the App may contain inaccuracies or errors and that we expressly exclude liability for any such inaccuracies or errors.

15.2    To the fullest extent permitted by applicable law, we hereby exclude all promises, whether express or implied, including any promises that the App is fit for purpose, of satisfactory quality, non-infringing, is free of defects, is able to operate on an uninterrupted basis, that the use of the App by you is in compliance with laws or that any information that you transmit in connection with this App will be successfully, accurately or securely transmitted.

 

16.     EXCLUSION OF OUR LIABILITY

16.1    Nothing in the Fanslide Terms shall exclude or in any way limit our liability for death or personal injury caused by its negligence or for fraud or any other liability to the extent the same may not be excluded or limited as a matter of law.

16.2    You have certain rights under the law. These include that we will provide services with reasonable skill and care and within a reasonable time.

16.3    You have certain legal remedies if we breach any of these rights which may apply irrespective of these Fanslide Terms. Nothing in the Fanslide Terms is intended to affect these legal rights or other rights to which you may also be entitled.

16.4    Subject to clause 16.2, you acknowledge and agree that we are not responsible for any damages, losses, expenses or claims which may be caused by any:

  • malfunctions (being where an automated process fails to operate as designed or intended and, as a result, produces a result that is not the result that was not intended. Malfunctions can occur, for example, if a piece of software operates incorrectly);
  • errors (being mistakes that arise from human mistakes or administrative, operational or systems failures. Errors can occur, for example, if incorrect data is submitted in relation to a Fixture by our third party data provider);
  • a failure of any of our third party providers (for example our third party data provider or provider of cloud based systems); or
  • events beyond our reasonable control which prevent us from providing all or part of Fanslide or fulfilling any of our obligations under the Fanslide Terms. Such events may include but are not limited to an act of god, an outbreak of hostilities, riot, civil disturbance, acts of terrorism, the act of any government or authority (including, but not limited to, any refusal or revocation of any licence or consent), fire, explosion, flood, theft, malicious damage, failure of telecommunications providers, strike, lock-out, or industrial action of any kind.

16.5    If we breach the Fanslide Terms, we shall only be liable to you for losses which are a reasonably foreseeable consequence of such a breach (which means that the losses could have been contemplated by you or us at the time of entering these Fanslide Terms). In no case shall we be liable for indirect, incidental or consequential damages (this means damages which are a side effect of the main damage and were not reasonably foreseeable at the time you entered into the Fanslide Terms).

  • Subject to clauses 1 to 16.5 inclusive, in no case shall our liability to you exceed the amount of £1.

16.7    The App is for domestic and private use. If you use the App for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. Equally, you must not use the app for the purposes of betting.

16.8    To the extent permitted by law, our third party data provider shall have no liability to you.

 

17.     TERMINATION

17.1    If, based on reasonable evidence, we believe you are in serious breach of the Fanslide Terms:

  • we will be entitled to suspend or terminate your right to use the App immediately (and/or suspend or terminate your Account);
  • we reserve the right to disqualify you from Games and Prize Competitions in progress; and
  • you must delete or remove the App from all Devices in your possession and immediately destroy all copies of the App which you have.

17.2    We reserve the right to permanently or temporarily suspend operation of the App at any time and make no commitment as to whether Games or Prize Competitions will be offered (whether or not a Game or Prize Competition has already been advertised or scheduled).

17.3    We may withdraw the App at any time.

 

18.     COMPLAINTS AND DISPUTES

18.1    Should you have a concern or complaint regarding our Service you should contact us, either by email at [email protected], or using the “Contact Us” function in the App.

18.2    Any complaints received more than 6 months from the date the event to which your complaint relates to occurred may not be considered.

 

19.     GENERAL

19.1    Any notice we give to you (save as otherwise set out herein) will be sent to the email address that you provided to us when you opened your Account.

19.2    If any provision (or part of a provision) of the Fanslide Terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

19.3    We are entitled to assign, transfer, charge or otherwise deal in our rights under the Fanslide Terms as we see fit but we will only do so where this will not prejudice your rights under the Fanslide Terms, or alternatively with your consent. We may wish to transfer our rights or obligations under the Fanslide Terms to another company within our corporate group or any other legal entity, including if we restructure or there is a sale of our business. You agree that we may do so provided that in the case of such a transfer, after we notify you of the date on which such transfer takes place, your rights under the Terms will be against the new legal entity.

19.4    The Fanslide Terms are personal to you and you may not transfer your rights or obligations under the Fanslide Terms to anyone else.

19.5    These Fanslide Terms form an agreement between you and us and are not intended to give any rights to any third party. This does not affect our right to transfer our rights under clause 19.3.

19.6    If you breach any of the Fanslide Terms and we do not take any action against you, we are still entitled to use our rights and remedies in any other situation where you breach the Fanslide Terms.

19.7    The Fanslide Terms shall be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute between them arising under or in connection with the Fanslide Terms or the App, save that if you live in Scotland, Northern Ireland or the Republic of Ireland you can bring legal proceedings in the courts of the country in which you live if you wish, but for the avoidance of doubt the governing law shall remain the law of England and Wales.
